Coping with the loss of a loved one is difficult. It is often a time marked by enormous emotional strain. In the midst of your grief, having to deal with funeral arrangements and family dynamics can seem overwhelming. Throw into that mix the prospect of "probate," a word that still invokes fear in a lot of people, and it might just be too much to handle. But you don't have to bear the burden alone. During this difficult time, you can turn to Gaddis, Kin, Herd & Craw, P.C. We have handled numerous probate cases over the decades. Larry R. Gaddis, Esq., and his paralegal Angelika M. Bush, CP, are an experienced team when it comes to dealing with a decedent's estate. Through years of acquired knowledge and experience in probate law and its changes, they can guide you in what to do from the time when someone dies all the way through handling and completing estate administration.
Probate is a court-supervised procedure for validating a will (if there is one), paying debts and distributing the property of a deceased person. Even if there is no will, the decedent's estate might still need to be probated to transfer the estate's assets. Probate laws vary from state to state. Fortunately, probate in Colorado follows the Unified Probate Code and allows for simplified procedures compared with the systems that are still in place in some other states.
Probate, however, is not the only way to deal with a decedent's estate. The estate might also qualify for a small estate proceeding, which is appropriate when the assets are less than $50,000 and no real estate is involved. If the decedent had a trust, it might also be possible to avoid probate.
