Probate is a court-supervised procedure for validating a will (if there is one), paying debts and distributing the property of a deceased person. Even if there is no will, the decedent's estate might still need to be probated to transfer the estate's assets. Probate laws vary from state to state. Fortunately, probate in Colorado follows the Unified Probate Code and allows for simplified procedures compared with the systems that are still in place in some other states.
Probate, however, is not the only way to deal with a decedent's estate. The estate might also qualify for a small estate proceeding, which is appropriate when the assets are less than $50,000 and no real estate is involved. If the decedent had a trust, it might also be possible to avoid probate.
