Estate Plan
An estate plan are the tools set in place to distribute or manage your property in the event of your incapacity or death, marriage or divorce. These tools include a will, trust, durable powers of attorney for finances and for health care, living will, life insurance, assignment of survivorship rights, prenuptial and postnuptial agreements, burial instructions, anatomical gift forms, and other legal documents, such as beneficiary deeds.
Wills
A will is a legal document that designates where your assets should go after your death and who should serve as executor or personal representative to settle your estate. It also governs who should take care of minor children. Without a will, the laws of the state will govern where your assets go and who should serve as your personal representative.
Trusts
A trust is a three party arrangement whereby you, the "grantor," transfer property to a "trustee," who will hold and manage the property for the "beneficiary." You could be all three parties, but there are a number of different constellations possible. There are also a number of different kinds of trusts you can choose from. While often advantageous, trusts are not always the best legal option to deal with an estate. There are a number of factors such as types of investments, personal circumstances, and goals you want to achieve, that influence the decision whether to establish a trust and what kind. That's why expert counsel is so vital in this area. If a trust is appropriate for you, we draft the trust and give you detailed guidance in how the trust should be administered. We will spend a great deal of time with you making sure you understand how the trust administration should be carried out and are available long after the trust was set up should you have questions concerning the trust.
